Overview

instxnt.xyz ("Service") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the Service that are reported to our designated DMCA Agent.

1. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your notice of infringement to our DMCA Agent with the following information:

Required Information for DMCA Takedown Request:

  1. Physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works at a single online site are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the URL(s) or other specific location on the Service where the material can be found.
  4. Your contact information: name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Designated DMCA Agent

Important: DMCA takedown requests sent to any other email address may not be processed. Please ensure your request includes all required information above.

3. Counter-Notification (Dispute a Takedown)

If you believe that material you posted on the Service was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent containing the following:

Required Information for Counter-Notification:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or if outside the USA, any judicial district in which instxnt may be found), and that you will accept service of process from the person who provided the original DMCA notification.

Upon receipt of a valid counter-notification, we will promptly forward it to the party who submitted the original DMCA takedown notice. If the original notifying party does not file a court action seeking a restraining order against the subscriber within 10-14 business days, we may restore the removed material.

4. Response Timeline

We aim to process DMCA takedown requests within the following timeline:

Takedown Requests

  • • Acknowledgment: Within 1-2 business days
  • • Review: Within 3-5 business days
  • • Action: Within 5-7 business days of receipt

Counter-Notifications

  • • Acknowledgment: Within 1-2 business days
  • • Forwarded: Within 3 business days
  • • Restoration: 10-14 business days (if no court action)

5. Repeat Infringers

In accordance with the DMCA and other applicable laws, instxnt has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Warning: Multiple valid DMCA complaints against your account may result in permanent account termination without prior notice.

6. False Claims Warning

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims.

If you are not sure whether material infringes your copyright, we suggest consulting an attorney before submitting a takedown request.

7. User Responsibility

Users of instxnt are responsible for ensuring that their storefronts and content do not infringe on the intellectual property rights of others. This includes:

  • Product images and photographs
  • Product descriptions and copy
  • Logos and branding elements
  • Scraped or imported content from other websites
  • Any AI-generated content based on copyrighted material

If you use our "Scrape Link" feature to import content from external sources, you must have proper authorization to use that content. See our Terms of Service for more details.
